another warning get citizenship sorted asap, you never know whats going to happen in the future
difficult one, his ILR has expired, so he has no valid visa to be in the UK, if they allow him to stay then many more will seek the same . rules are rules 2yrs outside the uk in one trip you lose your ILR. if he does leave and they have to apply for a settlement visa, will they be able to pass the minimum financial requirements
but then he's lived in Scotland for nearly 50 yrs
not a decision i would want to make

It's a very difficult one to call for sure.
Surely he could remain under DLR (Discretionary Leave to Remain)
UKBA state:-
Discretionary leave
If we do not recognise you as a refugee or a person who qualifies for humanitarian protection, we may give you another type of temporary permission to stay in the UK. This permission is called 'discretionary leave to remain'. How long you are allowed to stay will depend on your circumstances, but it is unlikely to be more than three years initially.
We will only give you discretionary leave to remain in limited circumstances. If you apply to renew it when it expires, we will review your circumstances before deciding whether to give you further permission to stay. See Active review for more details. You will not be able to apply for permanent residence until you have lived in the UK for at least six years (or 10 years in some cases). To extend your residence permit or apply for permanent residence, you will need to complete application form DL - see Extend your visa for more information.

Its such a sad case especially when myself have stipulated on here importance of becoming a british citizen, might sound alot but £874 for peace of mind need I say more.
I just hope some sort of common sense prevails for the poor guy really is a tough one.

the problem is if they give him dlr, they will have to give it everyone else who stays outside the uk 2yrs or more.
i'm surprised they let him back in the UK and wasn't refused entry.
