    Legal recognition of divorce in Philippines

    Hi all,

    is it only the filipino that can apply for this? or myself as a British can i apply for this through the courts to be able to update the NSO records and be able to obtain a CENOMAR.

    Do you mean judicial recognition of foreign divorce?? when you say british ( is it british national or british citizen??) when did you acquire your being british is it from birth ? where did your first marriage took place?? who filed the petition for divorce? have you got the absolute divorce decree??

    There is no divorce in the Philippines, but when a divorce is validly obtained abroad by an alien spouse from his or her Filipino spouse, the Filipino spouse shall have the capacity to remarry under Philippine law. However, the divorce obtained abroad must be passed upon judicially by a Philippine court to prove its validity before the Filipino spouse can remarry under Philippine law.

    So this means that only the filipino national if they return to philippines and wish to re-marry they need to get petition for divorce but the foreigner doesnt need to do that? is that the meaning?
