    new rules

    hi everyone

    Analita and i got married on the 17th July in phils. She is still there and im back here in uk (work commitments). MY question is do the new rules mean we cannot apply for a settlement visa until after the 5 year probation period. So it that is the case. What visa do i apply for now. Also who makes the application me or my wife.

    Your wife makes the application.

    She needs to apply for a Spouse visa. And I think that under the new rules she will then apply for ILR (Indefinite Leave to Remain in the UK) after 5 years have elapsed.

    someone said to apply for a settlement visa is this wrong . So we should apply for a spouse visa

    She will need to apply for a Spouse visa first. (I think that a Spouse visa is classed as a type of Settlement visa).

    Stick with the term Spouse visa. That is the one she needs to apply for. But you can often see it referred to as a (type of) Settlement visa.

    yes a spouse visa is a settlement visa, thats why you need to pay so much for the visa compared to other visa types
