divorce
can a phillipina start divorce proceedings from her phillipino husband from the u.k or is it annulment from u.k please advise .shes been seperated 4 years

There's no divorce in Philippines. She can only have her marriage annulled, not in UK but in Philippines.

Just to give you an answer on a technical level.
She can file for divorce in England after living here for one year.
If the divorce would be granted here, it is not recognised or valid in the Philippines .
If she would remarry, that also would not be recognised or valid in the Philippines.
She would be considered a bigamist there. Quite harsh penalties.

She wont get arrested at the airport if thats what you mean but if her legal husband in Philippines were to make a complaint then the PNP would
certainly have a duty to act.
The issue is being discussed more as Malta has now legalised divorce,leaving Philippines and Vatican as the only two countries where it is not permitted.
I predict urgent discussions in the Senate(if the impeachment trial ever ends) so expect a ruling in the next 20 or 30 years
There was the case about 20 years ago of the fugitive British scoundrel Lord Anthony Moynihan who forged his wife's signature on a divorce case held in Tunbridge Wells
He was married in Philippines where he remained and promptly married his girlfriend who bore a child a few months later.
When Moynihan died in 1991 his wife expected that their son would inherit the title and eventually take his seat in the Lords
The case was further complicated by his previous wife who had allegedly also borne him a son. DNA later proved he was not the father
The Committee of Priviledge ruled that as the later marriage was bigamous,his son could not inherit the title which was inherited by half brother Colin Moynihan,the former sports minister.

Hmm.....hope the ex got an annulment in the Phils then before she re-married in Sweden, as we were wed in the Phils and divorced here.
