I need help...I am married to a british for nearly 2 years now. But after leaving in the uk for 7 mo. We moved to US because of my husband work but we are planning to go back to uk after a year to process my ILR. My question is can I apply for a visa for my son in the Philippines which is 11 years to live with us in the UK?even i dont have my ILR yet? Please help me.

you could have applied at the same time as you did
you came to the uk, and lived here for 7 months ?, then becuase of your husbands job you moved to america ?? how long have you been in america ?
when was the last time you lived with your son ?

You should be able to bring your son over on a dependent visa.
I did this for my wife's son and daughter without any problems, but I believe she already had her ILR then.
Check the UK border agency site.

you don't need ILR to bring a dependent here
what you need to prove is you (but more likely your British partner can sponsor them, and you co-sponsor them) can support them without recourse to public funds, you have suitable accommodation for them, you have custody and 'sole responsibility'

Oh yes....forgot the bit about his biological father.
That could get complicated.
