Student Visa Holder .... To be Absorb by Company Is it possible?
Hi Good day,
This is not my case but from a friend who is a
student visa holder. He asked for help and thought
if anyone of you might have any idea on how he
will be going through this.
My friend is a student visa holder and his
visa will expire december of this year. Now, his
concerned is that the company that he is working
at the moment is willing to absorbed him but have
asked him to know the requirements and process.
With this regards below are his queries?
* Will he be able to upgrade his visa soon from
student to work permit?
* If it is possible, does he needs go back to the
Philippines to commence the process or is it
possible to just stay here.
* What are the requirements and how soon can he
start the application if this is possible? (As
ILR holders needs 28 days to apply before expiry
of visa)

I think his employer needs a sponsor license
employer need to advertise the job in Jobcentre Plus and one more publication. salary must be 22000/a above in order to score enough points.
the next step is for them to get a Certificate of Sponsorship, it is not a paper certificate but a reference number which contains his job title and salary etc. After they got this they will give him the number and he needs to quote it in his application form
i think its possible, depending on how skilled he is maybe tier 1?, if not tier 2 but he needs enough points.

as long as he currently holds a student visa, i think he can switch into T2 and does not have to go back home country.
but get him to check with UKBA, because you dont mention what he does, how skilled he is, what level is he studying..

information. I will try to pass this to him.
I dont know what tier he is on. But he is
a mathematician in the Philippines but now
he works in a residential care home and he
is on NVQ level 3 at the moment.
