Sorry for this old chestnut and for not searching for answer. The 23 month period before applying, is that from date of visa or date of arrival

the date you landed in the uk, but if you came more than 28 days after the issue (start date) of your visa, then you might have a problem as your visa could have expired if you have a 24month one.

have you got a 24 or 27 month spouse visa?

what date does your spouse visa expire ?

what date did you land in the UK ?

i got my spousal visa on dec 14 2007 and arrived in the uk in january 10 2009. i only have a 24 month visa.. it seems like mine falls exactly on the 28th day... which im guessing is dec 14.. can i send them the form one day before?

no problems for her then, i take it her visa expires 10 April 2010

as she came to the uk on the 18th of april 2008, she needs to be in the uk 2yrs so that would be the 18th of april 2010, but she can apply upto 28 days before she has been in the uk 2yrs, but before her visa expires (10/04/2010)!!!!.

so 18/04/2010 - 28 days = 21/3/2010 (but that's a Sunday !)

so she could apply from 22/3/2010 until 9/04/2010 (day before her visa expires if you use special next day delivery)

but i would apply on the 22/3/2010 so if there are any problems you have time to sort them out

so you entered the UK on the 10 jan 2008 so you will have been in the uk 2yrs on 10 jan 2010 but you can apply upto 28 days before that date.

so 10 jan 2010 - 28 days is 13th dec which is a sunday
you could post it on the 14th the day your visa expires, but i wouldn't if i was you,

you would get more problems applying late than too early, so i would do what your husband says and send it on Thursday so they get it Friday
