extension visa????
Hello,
Can anyone here help with some advice on my forthcoming unlimited leave to remain Visa?
We got married Dec 2006, and received my residence permit limited leave to remain visa last Feb 2007 and it will run out on Feb 2009.
But i had to leave last Nov 07 back to PI because my husband was work abroad, and i chose to be with my family, and when my husbands contract was finish we decided to come back to the UK, Aug 08. When we contact the home office before i arrived in UK asking about my visa, they told us that i need to apply for an extension visa??? ( which is getting me confused )
Now im all confused what will happen next, because we tried to email them but until now they have not answered, so will I still qualify in applying for a residence permit unlimited leave to remain?
Does anyone have advice regarding my situation???
I will appreciate all and any advice..

In your previous post you mentioned there about how long you've stayed in the PI. Since youve been away more than the allowed time they required that is why they asked you to apply for an extenson. You have to stay in the UK for 2 yrs before you can apply for ILR.

Im holding limited leave to remain right now Tin and will apply for settlement visa ( ILR or unlimited leave to remain) early next year too.

in ur case i think u need to extend ur visa (flr)after u have extended
ur visa completed your 2 years in uk you can apply for your ILR..
u need to pass the" life in the uk test" before you apply for ILR.

i stayed in PI for a good 9 months, but i just remembered that we are allowed for a 3 months out in uk if we are holding the limited leave to remain? correct me if im wrong.. and i tried to look in the net last night, and i cant find a proper application form for my exension visa, what im thinking is im going to apply for a new flrm?? i wish not..
again correct me if im wrong... tnx for the help though guys..

9months you out in UK so that mean you need to apply a FLR bcoz just only allowed 90days out in the UK

I dont need to apply vbkelly, thank God, my husband just phoned the HO, and they told us that, as long as you prove that you have cohabited together it should not be a problem. So im going to apply for my ILR now in October, woohhooo... tnx to you guys for all the advices...

there is no set figure, but 90days is seen as a safe figure, but 9 months, well see below as you were not living together, and your asked on the set (m) form if you have lived apart outside the uk.

4.5. Further guidance
There is no specific requirement in the Rules that the entire probationary period must be spent in the United Kingdom. For example, where an applicant has spent a limited period outside of the United Kingdom in connection with his employment, this should not count against him. However, if he has spent the majority of the period overseas, there may be reason to doubt that all the requirements of the Rules have been met. Each case must be judged on its merits, taking into account reasons for travel, length of absences and whether the applicant and sponsor travelled and lived together during the time spent outside the United Kingdom. These factors will need to be considered against the requirements of the Rules.
