View Full Version : Divorce in UK, by Filipina on a visitor's visa

I have a relation who is Filipino living in ROP.

She has been trying to get an annulment for a couple of years, each time it seems close, there is a ‘request’ for more ‘legal fees’.

Just a thought.

If she travels to UK as a visitor,
1. in what circumstances could her husband in ROP divorce her in UK ? I understand that he would / might be willing to go along with anything legal to achieve that.
2. Could she divorce her husband through the courts in UK ?

I understand the situation that only the defendant would be considered as divorced and thus free to remarry, by the ROP legal system.

John, for a Filipino national, it doesn’t matter where in the world they file for divorce, such divorce is not recognised as valid in the Philippines.

Besides which, divorce in England & Wales requires that the Petitioner is domiciled here and has been habitually residing here for at least 6 months. Mean can't be done whilst on visit visa.
