    Filipino mother of baby who has British nationality, her right to reside in UK ?

    Can anyone tell me what the position is?

    We have a Filipino friend who is divorced from her British husband (he has remarried). They had a baby who has British nationality. The mother has permanence Residencia status in EU.

    The child (aged 5) can of course reside in UK. So does the mother have a right to reside in UK with her child ?

    i think 2 things, if she has PR in the EU then she can go and live in another Eu state for i think 3 months before she has to start exercising her treaty rights.

    if she can't for some reason then it could also be possible she could get the right to access a child living in the uk, but i dont think she can work etc. better trying the euro way.

    Thanks Joe, but a person with permanent residencia Status in an EU country cannot even visit UK without a visa (including Ireland and Gibraltar). Only an EU nationall has the right to live in another EU country.

    Thanks for the attachment. I have only had time to glanced through it (will read it fully later) but it seems on the first Key Point a stumbling block appears 'The child is Resident in UK.' He is resident in Spain at present.
